Terms and Conditions for the TruthSeeker Service (App and Website)

Effective Date: 1st September 2025

Welcome to TruthSeeker (the "Service"), an artificial intelligence-powered application and website provided by TrendTrack Management, a Legal Entity, ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Service, including any content, functionality, and services offered on or through the TruthSeeker mobile application (the "App") and website (the "Site").

These Terms & Conditions govern the use, registration and subscription to the Service, and any donations made through the TruthSeeker platform (the “Service”). By using, registering, subscribing or donating, to TruthSeeker, you agree to these Terms & Conditions in full. If you do not agree with any part of these Terms, you must not access or use the Service. These Terms form a binding legal agreement between you and TrendTrack Management. You represent that you are of legal age to form a binding contract (at least 18 years old in most jurisdictions) and have the authority to enter into these Terms.

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on the Site or App and updating the "Effective Date" above. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

1. Description of the Service

The Service provides AI-driven tools, including but not limited to generative AI features for content creation, chat interfaces, data analysis, and other functionalities accessible via the App and Site. The Service may integrate third-party services, APIs, or models, subject to their respective terms.

2. Eligibility and Account Registration

To use the Service, you must:

• Be at least 18 years old (or the age of majority in your jurisdiction).
• Provide accurate information during registration.
• Maintain the security of your account credentials.

You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts for violations of these Terms.

3. License Grant

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal non-commercial purposes only, as applicable. This license does not include rights to:

• Copy, modify, distribute, sell, or lease any part of the Service.
• Reverse engineer, decompile, or disassemble the Service.
• Use the Service for competitive analysis or to develop similar products.

4. User Content and Inputs/Outputs

You may provide inputs ("Inputs") to the Service, such as prompts, data, or files, which the AI may process to generate outputs ("Outputs"). Collectively, Inputs and Outputs are "User Content."

Ownership: You retain ownership of your Inputs. We claim no ownership of Outputs, but you grant us a worldwide, royalty-free, perpetual license to use, host, store, reproduce, modify, create derivative works of, and distribute your User Content solely to provide and improve the Service (including training our AI models, unless you opt out via account settings).

Your Responsibilities: You are solely responsible for your User Content. You represent and warrant that your Inputs do not violate any laws, third-party rights (e.g., intellectual property, privacy), or these Terms. Outputs may contain inaccuracies, biases, or harmful content; you must independently verify and use them at your own risk.

Prohibited Use: Do not submit User Content that is illegal, harmful, abusive, or infringing. We may review, remove, or refuse User Content at our discretion.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in compliance with all applicable laws, regulations, and these Terms. Prohibited activities include:

• Violating intellectual property rights, privacy rights, or publicity rights.
• Engaging in harassment, hate speech, or discrimination.
• Generating or distributing harmful, deceptive, or illegal content (e.g., deepfakes, malware).
• Using the Service for high-stakes decisions in critical areas like healthcare, finance, or legal advice without professional verification.
• Attempting to circumvent security measures or overload the Service.

We may enforce these rules through automated systems, human review, or termination of access.

6. Third-Party Services

The Service may include links to or integrations with third-party websites, apps, or services ("Third-Party Services"). We are not responsible for Third-Party Services, their content, or their terms. Your use of Third-Party Services is at your own risk and subject to their separate agreements.

7. Subscriptions, Donations and Payment

Certain features of the Service may require payment ("Subscription and Donations). Subscription Plans are described on the Website. You agree to pay all as specified. We may change these with notice. All payments are non-refundable except as required by law.

Subscription Payments

Payments are processed securely by our payment partners Paddle.com. When you subscribe to a plan, you authorize Paddle to charge your chosen payment method.

• All prices are listed in your local currency where available and inclusive of applicable taxes (such as VAT).
• At the end of your 12 month subscription period you can, if you so wish, cancel your subscription by e-mailing your Account details to support@truthseeker.cloud

Refunds

Paddle is the Merchant of Record and handles refunds on our behalf. If you believe you are eligible for a refund, please contact Paddle support within 14 days of subscribing.

Donations

Donations to TruthSeeker are non-refundable and we use the Pioneer Payment Service for these.

8. Intellectual Property

The Service, including all software, algorithms, models, and content (except User Content), is owned by us or our licensors and protected by copyright, trademark, and other laws. No use of our trademarks or intellectual property is permitted without our prior written consent.

9. Privacy

Your use of the Service is also governed by our[Privacy Policy, which describes how we collect, use, and disclose personal information.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. AI OUTPUTS MAY BE INACCURATE OR INAPPROPRIATE; WE DO NOT GUARANTEE THEIR ACCURACY, COMPLETENESS, OR SUITABILITY. WE DO NOT ENDORSE OR VERIFY THIRD-PARTY CONTENT.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE OR OUR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR US $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or damages arising from your violation of these Terms, your User Content, or your use of the Service.

13. Termination

We may suspend or terminate your access to the Service at any time for violations of these Terms or for business reasons, with or without notice. Upon termination, your right to use the Service ends, but Sections 4, 7-15 survive.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of South Africa, without regard to conflict of law provisions . Any disputes shall be resolved exclusively in South African courts.

15. Miscellaneous

Severability: If any provision is invalid, the remainder remains in effect.

No Waiver: Our failure to enforce any right does not waive it.

Assignment: We may assign these Terms; you may not without our consent.
